After 9 days, Canadian Motor Speedway, The Town of Fort Erie and Niagara Region lawyers presented their final submissions to Ontario Municipal Board Madam Chair Susan Schiller on Thursday June 28th, recapping their evidence and witness statements to try and sway the OMB to either approve or reject the project!
Town of Fort Erie Legal council Paul Demelo says the OMB will rule based on evidence if it’s good planning and legal use of re-zoned land, whether it’s a race track or any other type of structure.
The OMB doesn’t rush decisions.
We are likely looking at late summer or early fall, October most likely, to release their ruling.
Chief CMS developer Azhar Mohammad is very happy with the case his lawyers and the town and Niagara region solicitors presented.
They backed everything up with solid evidence and witnesses that PALS in many instances didn’t try and refute.
The only group left opposing the speedway, “PALS”, or “Preservation Agricultural Land Society” did not appear to hear or believe the CMS witnesses that most of not all of their issues concerning environmental impact on the wildlife, water and topography on the subject lands will be addressed when CMS applies for building permits.
If the OMB approves the development, Mohammad thinks we could see a ground breaking late fall.
If approved, Canadian Motor Speedway will re-write Canadian Motorsport history, in that the complex will include Canada’s first one-mile high banked oval designed by Jeff Gordon, to attract NASCAR and IndyCar events.
The complex will also include a 2.5 mile road course.
Raceline Radio attended each and every session every day of the hearing.
We were the only media covering the hearing!
That suits us fine!
In my observation PALS put up a very flimsy case that did not present any evidence or witnesses that convinced the OMB Canadian Motor Speedway is not good planning.
I am more optimistic than ever!

hearing, that would convince the OMB this is not good planning and proper use of re-zoned land. CMS supported their case very well. The OMB makes a decision based on
evidence. I firmly believe they will not do “stupid”. Fingers crossed. Always have been.
